(AP) ? All nine people injured during a dramatic confrontation between police and a gunman outside the Empire State Building were wounded by gunfire from the two officers, police said Saturday, citing ballistics evidence.

The veteran patrolmen who opened fire on the suit-clad gunman, Jeffrey Johnson, had only an instant to react when he whirled around and pointed a .45-caliber pistol at them as they approached him from behind on a busy sidewalk.

Officer Craig Matthews shot seven times, and Officer Robert Sinishtaj fired nine times, police said. Neither had ever fired their weapons before on a patrol.

The volley of gunfire felled Johnson in just a few seconds and left nine other people bleeding on the sidewalk.

In the initial chaos Friday, it wasn't clear whether Johnson or the officers were responsible for the trail of the wounded, but based on ballistic and other evidence, "it appears that all nine of the victims were struck either by fragments or by bullets fired by police," Police Commissioner Raymond Kelly told reporters Saturday at a community event in Harlem.

Police officials have said the officers appeared to have no choice but to shoot Johnson, whose body had 10 bullet wounds in the chest, arms and legs.

The officers confronted Johnson as he walked, casually, down the street after gunning down a former co-worker on the sidewalk outside the office they once shared. The shooting happened at 9 a.m., as the neighborhood bustled with people arriving for work.

The gunman and his victim, Steve Ercolino, had a history of workplace squabbles before Johnson was laid off from their company, Hazan Import Corp., a year ago. At one point, the two men had grappled physically in an elevator.

John Koch, the property manager at the office building where the men worked, said security camera footage showed the two pushing and shoving. The tussle ended when Ercolino, a much larger man, pinned Johnson against the wall of the elevator by the throat, Koch said. Ercolino let him go after a few moments, and the two men went their separate ways.

"They didn't like each other," Koch said.

After shooting Ercolino, Johnson, an eccentric T-shirt designer and avid bird-watcher who wore a suit every day, even when photographing hawks in Central Park, walked away as if nothing had happened.

Alerted by a construction worker, officers Matthews and Sinishtaj gave chase as Johnson rounded a corner and walked along Fifth Avenue in front of the landmark skyscraper.

A security videotape from the scene shows several civilians ? including three sitting on a bench only a few feet away ? scattering as the officers opened fire.

Police have determined that three people were struck by whole bullets ? two of which were removed from victims at the hospital ? and the rest were grazed "by fragments of some sort," Kelly said.

Two women with leg wounds and a man with a wound to his buttocks required surgery and remained hospitalized Saturday. They were listed in stable condition.

Both Matthews, 39, and Sinishtaj, 40, joined the nation's largest police department 15 years ago.

Matthews had drawn attention this year by suing the New York Police Department, accusing his superiors of unfairly punishing him for not meeting arrest quotas. A judge threw out the complaint.

The union representing the two officers didn't immediately respond to a message left seeking comment.

The shooting didn't deter tourists from flocking to the Empire State Building as usual on Saturday.

Patricia Flynn, 57, a retired schoolteacher, visited the building's peak with her elderly mother, who once worked in the skyscraper as a secretary.

"But I didn't tell her what happened," said Flynn, adding that her mother was unaware of Friday's shooting. "And she really enjoyed the view."

A group of 31 tourists from France held a meeting Friday night at their nearby hotel to decide whether to cancel their planned Empire State Building visit.

"We were scared, and we thought it was a risk," said Catherine Krukar, 38, a teacher.

But in the end, they went ahead with the visit, she said after descending from the observation tower,

"We know it can happen anywhere, and we wanted to see the Empire State Building," Krukar said. "It was beautiful!"

Leading forecasters are predicting the continued recovery of UK commercial property values in the new year. The IPD index shows a remarkable rebound, and total returns may even become positive after the largest monthly rise ever in the history of the index in November of 2.4%.

The market rally since August has caused considerable uncertainty for the year ahead, particularly as it has defied fundamental reasons for price restraint such as flagging occupier demand and rental declines.

However, while few expect prices to rise at the same pace, many forecast that next year will be positive for returns from property. The consensus view is broadly that capital values will plateau, with total returns settling at 6 to 10% for the next two years. There is a range of other opinion, however.

William Hill, head of property at Schroders, forecast that the sharp turnround in the performance of UK commercial property would continue through the first six months of 2010. After that, however, he said that the picture was less clear, with economic uncertainty meaning that the market was likely to experience further volatility over the next two to three years and potentially a fall in values in 2011.

Harm Meijer, an analyst at JPMorgan, expects property prices to bounce by 15% between June 2009 to June 2010, before settling into sluggish growth or a modest decline for two years. This will give a compound price growth of 4% a year over a five-year period. He said that the rally in real estate stocks was over, but that there was expected to be a 12% total return from the European listed sector next year. His picks in the UK were Big Yellow and British Land.

CB Richard Ellis, the property consultancy, also believes the market is not in the grip of an unsustainable "mini-bubble", saying that many measures of yield and value were still in comfortable territory relative to long-run averages. The UK, it forecast, looked likely to lead other markets in its recovery.

There is expected to be about '60billion (?55billion) of investment activity in the European commercial real estate market in 2009, about half of the total from the previous year. CBRE expects there to be a steady rise in activity in 2010, although this will be restrained by the focus on prime property, which is in relatively short supply.

Leasing activity in 2009 is likely to be at about a third of 2008 levels, but CBRE expects this also gradually to recover as economic prospects improve during the latter half of 2010.

King Sturge, a rival property agency, forecast that the UK investment bubble would soften in the first quarter. It said prime property had shown growth of 20% in values in the past year, but the impact of an end to quantitative easing, higher tax rates, election uncertainty, unemployment, the Dubai crash and better savings rates would take the steam out of the market.

"Whether it is a VW, or a 'corrugated' recovery, it is not a straight line up from here," said Neville Pritchard, head of UK investment at King Sturge, echoing the sentiment from many veteran investors such as Nick Leslau and Mike Slade .

Secondary stock will continue to languish, he added. "Those who anticipate a substantial rebound in poorer quality stock are mistaken." He said central London offices and the best quality retail parks would continue to find favour with risk-averse investors.

Savills, the real estate adviser, also said that the London market was set to fare well. In a report published alongside Oxford Economics, the economic forecaster, Savills said that London would re-emerge as the fastest growing large European destination and one of the fastest expanding global financial centres, exceeding New York and Tokyo in the medium term.

John Rigg, head of international investment at Savills, said: "Concerted central bank action and the fall in sterling combined with London's intrinsic attractions are causing a rapid recovery to certain markets."

Bus collides with tanker in China, killing 36

(AP) ? A double-decker sleeper bus collided with a tanker on a northern Chinese highway early Sunday, causing both vehicles to burst into flames and killing 36 people, state media said.

The tanker was transporting methanol and collided with the bus at around 2 a.m. on a highway near the city of Yan'an in Shaanxi province, the official Xinhua News Agency said.

An official with the local Communist Party propaganda bureau in Yan'an confirmed that the crash occurred but was unable to give details and was unsure of the death toll.

Xinhua said 39 people were on board the two vehicles when the crash occurred and only three people survived. They were taken to hospital with injuries, it said.

Road safety is a serious problem in China. According to Xinhua, poorly maintained roads and bad driving habits result in about 70,000 deaths and 300,000 injuries a year.

10 NBA All-Stars Who Will Never Win a Championship

Winning an NBA title is really, really difficult. Just ask Dominique Wilkins, Charles Barkley, Patrick Ewing, Reggie Miller, Karl Malone and John Stockton. Or, for those of you from a slightly older generation, ask George Gervin.

There are certain players that, for one reason or another, just will not win a championship anytime soon. Either they themselves are fatally flawed or their agent led them astray when they signed on to their teams.

Similarly, there are certain teams that, for one reason or another, just will not win a championship anytime soon. Either they're fatally flawed or just have certain imperfections that will block their way in the playoffs.

On the other hand, some players are too good not to win a championship. LeBron silenced all his critics by leading the Miami Heat to a dominating five-game series win over the Oklahoma City Thunder in the NBA Finals.

Like LeBron, Chris Paul and Kevin Love are both excellent players. After getting a taste of gold this summer in London, they will both be hungry for a championship. While a change of scenery will be required for this, I envision both of them finding greener pastures and a championship on a new team.

Obviously, basketball is a team sport, but the nature of the game is that one great player can take over and exert his will on the opposition. There are only five guys on the court at one time, and truly elite players rise to the occasion in the playoffs. There are no excuses.

All the players on this list have a concrete flaw that will prevent them from ever winning an NBA championship. Either they are already too old, or too injury-prone or just have personal flaws that will doom them and their teams in postseason play.

Some players just aren't "clutch," while others are. There is Nick Anderson, and then there's Robert Horry (and Robert Horry, and Robert Horry). There is Tony Romo, and then there's Eli Manning.

So with that, I've peered into my crystal ball to give you this list of 10 NBA All-Stars who will never attain a championship.

India faces Twitter backlash over Internet clampdown

NEW DELHI (Reuters) - The Indian government faced an angry backlash from Twitter users on Thursday after ordering Internet service providers to block about 20 accounts that officials said had spread scare-mongering material that threatened national security.?

The backlash came as New Delhi turned up the heat on Twitter, threatening "appropriate and suitable action" if it failed to remove the accounts as soon as possible. Several Indian newspapers said this could mean a total ban on access to Twitter in India but government officials would not confirm to Reuters that such a drastic step was being considered.?

There was no immediate response from Twitter, which does not have an office in India. There are about 16 million Twitter users in the South Asian country.?

The government has found itself on the defensive this week over what critics see as a clumsy clampdown on social media websites ? including Google, YouTube and Facebook ? that has raised questions about freedom of information in the world's largest democracy.

According to documents obtained by Reuters, the government has targeted Indian journalists, Britain's Daily Telegraph, the Australian Broadcasting Corporation and Al Jazeera television in its clampdown on Internet postings it says could inflame communal tensions.?

The directives to Internet service providers listed dozens of YouTube, Facebook and Twitter pages. A random sampling of the YouTube postings revealed genuine news footage spliced together with fear-mongering propaganda.?

The government says Google and Facebook have largely cooperated while Twitter has been much slower to respond.?

"Every company, whether it's an entertainment company, or a construction company, or a social media company, has to operate within the laws of the given country," said Sachin Pilot, minister of state in the Ministry of Communications.?

Twitter has been instructed to remove 28 pages containing "objectionable content", an interior ministry official said.?

"If they do not remove the pages, the Indian government will take appropriate and suitable action," he added.?

The government has ordered Internet service providers to block the Twitter accounts of veteran journalist Kanchan Gupta and television anchor Shiv Aroor. Some appeared to have begun complying with the order on Thursday as Twitter users reported difficulties in accessing their pages.?

"It is a political decision, because of my criticism of the government," said Gupta, who was an official in the previous government led by the Hindu nationalist Bharatiya Janata Party.?

The government's actions triggered a storm of criticism from Twitter users, with the hashtags #Emergency2012 and #GOIBlocks among the top trending topics on Twitter in India on Thursday. Some compared the situation with the state of emergency imposed by the government in 1975, when some journalists were jailed.?

The Centre for Internet and Society, which analyzed the 300 banning orders, found that they contained "numerous mistakes and inconsistencies". Some of the banned websites belonged to people trying to debunk the rumors, for example, it said.?

"This isn't about political censorship. This is about the government not knowing how to do online regulation properly," said CIS program manager Pranesh Prakash.?

India's parliament last year passed a law that obliges Internet companies to remove a range of objectionable content when requested to do so, a move criticized at the time by rights groups and social media companies.?

Syrian army batters parts of Damascus, 47 killed

AMMAN/ALEPPO, Syria (Reuters) - The Syrian army shelled southern Damascus on Wednesday and helicopters fired rockets and machineguns during an assault meant to shore up President Bashar al-Assad's grip on the capital 17 months into an uprising, opposition activists said.

The army has this week used tanks and helicopter gunships in an offensive around Damascus that coincided with the departure of U.N. military observers, their mission to stop the bloodshed and nudge Syria towards a peaceful transition a failure.

The United Nations estimates that more than 18,000 people have been killed in what has become a civil war after the state's violent response to peaceful street protests triggered an armed rebellion in the pivotal Arab country.

Anti-Assad activists said at least 47 people had been killed in Damascus in what they called the heaviest bombardment this month. "The whole of Damascus is shaking with the sound of shelling," said a woman in Kfar Souseh, one of several districts hit in the military offensive to root out rebel fighters.

The United Nations said some of the weapons being used by government forces appeared to have been supplied by Iran, in violation of a U.N. resolution that banned such exports.

U.N. Secretary-General Ban Ki-moon will raise the Syria crisis with Iran at a summit of non-aligned developing nations in Tehran next week, a U.N. spokesman said.

As the army continued to shell southern Damascus, activists said at least 22 people had been killed in Kfar Souseh and 25 in the nearby district of Nahr Eisha.

One of the dead was named as Mohammad Saeed al Odeh, a journalist employed at a state-run newspaper who was sympathetic to the anti-Assad revolt. Activists said he had been executed in Nahr Eisha.

"There are 22 tanks in Kfar Souseh now and behind each one there are at least 30 soldiers. They are raiding houses and executing men," an opposition activist in Kfar Souseh, who gave his name only as Bassam, told Reuters by Skype.

More than 250 people, including 171 civilians, were killed across Syria on Tuesday, mostly around Damascus, Aleppo and the southern city of Deraa, according to the Syrian Observatory for Human Rights, a British-based opposition monitoring group.

Activists in the southwestern Damascus suburb of Mouadamiya said Assad's forces had killed 86 people there since Monday, half of them by execution. It was not possible to verify that report.

There was no immediate government account of the latest fighting. But state television broadcast footage of weapons it said had been seized from rebels in Mouadamiya, one of the first districts to join the uprising.

The conflict, which pits a mainly Sunni Muslim opposition against a ruling system dominated by Assad's Alawite minority, threatens to destabilize neighbors including Lebanon, where Sunni-Alawite violence flared for a third day.

The death toll from the fighting in the northern Lebanese city of Tripoli rose to at least 10 with more than 100 wounded, medical sources said, in what residents said were some of the fiercest clashes there since Lebanon's 1975-90 civil war.

The Syria conflict has revived old tensions in Tripoli between pro-Assad Alawites in the hilltop district of Jebel Mohsen and their Sunni neighbors in Bab al-Tabbaneh below.

In Syria, Assad's forces have lost swathes of territory in recent months, but have fought back hard in Damascus and in Aleppo, the country's biggest city and commercial hub until it became a theatre for urban warfare.

Reuters journalists in Aleppo on Wednesday heard gunfire and shells exploding every minute.

Rebels trying to advance in Saif al-Dawla, a front-line Aleppo district, encountered mortar and rocket-propelled grenade fire. At one point, their escape route was cut off by gunfire as tank shells exploded nearby. Much of the area was destroyed.

State television said government forces were pursuing "the remnants of armed terrorist gangs."

Donatella Rovera, a senior crisis response adviser for Amnesty International, who recently returned from a 10-day visit to Aleppo, said the rights group investigated some 30 attacks in which scores of civilians not involved in hostilities, many of them children, were killed or injured in their homes, while queuing for bread and even in places where those displaced by the conflict were sheltering as a result of indiscriminate attacks against residential neighborhoods.

"The use of imprecise weapons, such as unguided bombs, artillery shells and mortars by government forces has dramatically increased the danger for civilians", Rovera said.

While the situation at the front line remained difficult, just 400 meters (400 yards) behind it, women and children were walking down the streets casually - some carrying groceries - and just 1 km back streets were bustling with normal life.

Children carried groceries from shops doing brisk business and couples held hands as smoke from the fighting rose into the sky behind them.

Away from the main cities, government forces fought rebels for control of a military base and airfield near the eastern town of Albu Kamal on the Iraqi border, according to a local Iraqi official and a Syrian rebel commander.

The rebel commander, known as Abu Khalid, said his forces now controlled Albu Kamal, straddling a supply route from Iraq where many Sunni tribes sympathize with their Syrian kin.

But rebels were on the back foot near the border with Turkey after Syrian soldiers backed by helicopters attacked a village to try to cut off a supply line, opposition sources said.

At least three people were killed and 10 wounded when army helicopters bombarded Qastoun, a village in Hama province, 24 kms (15 miles) east of the Turkish border, and rebels fought loyalist troops, the Hama Revolutionary Council said.

As Syria slips deeper into chaos, the United States and Israel have voiced concern that Assad might lose control of his chemical weapons arsenal or even be tempted to use it.

Russia, a Syrian ally since Soviet times, believes Syria has no intention of using its chemical weapons and is able to safeguard them, the Russian newspaper Kommersant reported on Wednesday, citing an unidentified Foreign Ministry official.

U.S. President Barack Obama threatened Assad on Monday with "enormous consequences" if he employed chemical weapons or even if he moved them in a menacing way, drawing a warning from Russia against any unilateral action by the West.

In telephone conversations with Obama and French President Francois Hollande, British Prime Minister David Cameron discussed "how to build on the support already given to the opposition to end the appalling violence in Syria," Cameron's office said.

The White House said Obama conveyed his concerns on the call about the "increasingly dire humanitarian situation in Syria," and the need for contributions to humanitarian appeals in the region.

Lakhdar Brahimi, the incoming U.N. mediator on Syria, met representatives of the Free Syrian Army in Paris on Wednesday. The group said it was skeptical he would succeed where his predecessor - Kofi Annan - had failed.

"Foreign intervention that is not through a Security Council resolution is something that very seldom works," Brahimi told Finnish public broadcaster YLE.

"My instinct is to say please, let's see if we can solve this problem without external military intervention."

Teacher Ideas | Dyslexia and the Special Education Law

The mere utterance of the word dyslexia within the confines of a school campus can stop a conversation and create a divide between a parent and that school. This does not have to be the case and there is information teachers can arm themselves with and become a resource and support for parents/guardians who are concerned about their children. I listed a few myths and misconceptions below and their counterpart, the truth.

Dyslexia is a broad term and we do not recognize it:

Not so fast. It is listed in IDEA as one of the qualifying conditions: Yep, right there under Specific Learning Disability (SLD), check it out for yourself:

Specific learning disability means a disorder in one or more of the basic psychological processes involved in understanding or in using language, spoken or written, that may manifest itself in an imperfect ability to listen, think, speak, read, write, spell, or to do mathematical calculations, including conditions such as perceptual disabilities, brain injury, minimal brain dysfunction, dyslexia, and developmental aphasia.

Also important to note is that SLD is a broad term which encompasses several conditions. This is important because stating that dyslexia is a broad term as an excuse to dismiss it is ubiquitous in many an IEP/SST/504 meeting ? it is just not true.

It?s too early to test for dyslexia:

Symptoms of dyslexia present themselves as early as three years old. Standardized testing can detect it as early as kindergarten ? if conducted by a trained professional. Legally, failure to identify a child who is obviously struggling can cost the school district in the future, so don?t be afraid to recommend a student for testing early in their schooling. This will not only save the school district money in the future, but possible save the child from an unpleasant school experience.

We will just hold him back and he will ?soar.?

This might the most detrimental thing we can do to a child with dyslexia. If a child with dyslexia is held back and the intervention is the same as the year before, he will not improve. The intervention has to change, not the child.

I don?t need to defend my credential:

Well, yes you do. Please resist the very natural temptation to become defensive when asked about your credentials: No Child Left Behind (NCLB) gives parents the right to ask the following questions:

(1) Whether the teacher has met State qualification and licensing criteria for the grade levels and subject areas in which the teacher provides instruction;

(2) Whether the teacher is teaching under emergency or other provisional status through which State qualification or licensing criteria have been waived.

(3) The baccalaureate degree major of the teacher and any other graduate certification or degree held by the teacher, and the field of discipline of the certification or degree.

(4) Whether the child is provided services by paraprofessionals and, if so, their qualifications.

A teacher educated about dyslexia can be the one person who saves a child and his/her family from years of frustration and anxiety. That teacher can play a pivotal role in changing the whole culture of a school. Remember, it takes a village to raise a child and a village of advocates to raise a child who struggles.

Ryan called stimulus wasteful, then sought funds

(AP) ? Republican vice presidential candidate Paul Ryan has been one of the harshest critics of President Barack Obama's economic stimulus plan. But months after Congress approved the nearly $800 billion package, the Wisconsin lawmaker was trying to steer money under the program to companies in his home state.

Rep. Ryan wrote letters in 2009 to Energy Secretary Steven Chu and Labor Secretary Hilda Solis seeking stimulus grant money for two Wisconsin energy conservation companies. One of them, the nonprofit Wisconsin Energy Conservation Corp., later received $20.3 million from the Energy Department to help homes and businesses improve energy efficiency, according to federal records.

In a letter to Chu in December 2009, Ryan said the stimulus money would help his state create thousands of new jobs, save energy and reduce greenhouse gas emissions. That contrasted with his public statements denigrating the stimulus program as a "wasteful spending spree." It also conflicts with his larger federal budget proposal, which would slash Energy Department programs aimed at creating green jobs.

Ryan's office says his budget plan "calls for getting Washington out of the business of picking winners and losers in the economy ? and that includes our energy sector."

Ryan's actions in Congress and as chairman of the House Budget Committee have been drawing fresh scrutiny since he was named last weekend as Republican presidential candidate Mitt Romney's running mate.

A Ryan spokesman, Brendan Buck, noted the congressman's office's previous explanations that he was "providing a legitimate constituent service." The Wall Street Journal reported Ryan's efforts to secure stimulus money two years ago.

"If Congressman Ryan is asked to help a Wisconsin entity applying for existing federal grant funds, he does not believe flawed policy should get in the way of doing his job," Ryan's office said then.

Ryan also sent three letters to Chu in October 2009 seeking stimulus money for the Energy Center of Wisconsin, another nonprofit organization that promotes energy efficiency. The company later received $190,000 in stimulus money to conduct research on geothermal heating and $50,000 more to develop a training curriculum for students at Milwaukee Area Technical College.

Ryan's letters to the Energy Department were first reported by the Boston Globe.

"It's another example of how he talks out of both sides of his mouth," said Heather Taylor-Miesle, director of the Natural Resources Defense Council Action Fund, a political affiliate of the national environmental group. "It goes to show that their energy policy always has been, and probably always will be, disingenuous."

The vice presidential contender is not alone among Republicans who criticized the stimulus plan only to seek money later. Georgia's Republican senators, Saxby Chambliss and Johnny Isakson, for example, blasted the bill as a bloated government giveaway yet asked Defense Secretary Robert Gates to steer $50 million in stimulus money to a constituent's bio-energy project.

Ryan's views are also consistent with his running mate's long-held position that the stimulus was a flawed idea that did not create private sector jobs.

"That stimulus didn't work," Romney said at an Ohio speech in June. "That stimulus didn't put more private-sector people to work."

Yet, in Ryan's letter to the Labor Department in October 2009, he backed the Energy Center of Wisconsin's grant application for stimulus money "to develop an industry-driven training and placement agenda that intends to place 1,000 workers in green jobs."

The company did not win the Labor Department grant.

Frank Greb, president of the Energy Center of Wisconsin, said the company sought help from the entire Wisconsin congressional delegation, a practice he described as routine. He said other lawmakers ? Democrats and Republicans ? also sent letters in support of the grants.

"I'm not surprised that any congressman would be supportive of entities within his district if he saw merits in the work and it was going to be beneficial to constituents," Greb said.

Ryan's budget proposal would cut billions in Energy Department funding for the development of clean energy and eliminate loan programs that have helped support 60,000 jobs, according to Rep. Henry Waxman, top Democrat on the House Energy and Commerce Committee.

An Amish-Mennonite pastor who helped a mother and her 7-year-old daughter flee the U.S. to Nicaragua so that she wouldn?t have to share custody with her former lesbian partner was found guilty Tuesday of aiding in international parental kidnapping of a minor.

Prosecutors say that Kenneth Miller, 46, who worked in his family?s garden supply business, coordinated with Mennonites to drive Lisa Miller and her daughter, Isabella, to an airport in Canada and to then pick them up in Nicaragua, where the group runs a mission.

Prosecutors say Lisa Miller fled after a Vermont judge made it clear in August 2009 that he would transfer custody of Isabella to her former partner, Janet Jenkins, if she continued to disobey the court's visitation orders.


The women had separated six years before when Isabella was 17 months old; according to The New York Times, Lisa Miller had turned to religion and renounced being gay.

The New York Times reported that Lisa Miller wrote a pleading letter to a Vermont judge, explaining her position: ?What is at stake is the health and well-being of an intelligent, delightful, beautiful, 7-year-old Christian girl,? she wrote. Isabella ?knows from her own reading of the Bible that marriage is between a man and a woman ? that she cannot have two mommies, that when I lived the homosexual lifestyle I sinned against God, and that unless Janet accepts Christ as her personal savior, she will not go to heaven.?

The case has drawn widespread attention, pitting gay rights groups against evangelical Christian groups in the legal battle between the two women over Isabella, now 10.

Lisa Miller and Jenkins entered a civil union in Vermont in 2000. According to court records, Jenkins paid $50,000 to facilitate in vitro fertilization, which led to Lisa Miller giving birth to Isabella in 2002. The couple broke up a year and a half later, and Lisa Miller returned to her native Virginia with the couple?s daughter.

A custody battle ensued in Vermont and Virginia courts, with the supreme courts in both states eventually ruling the disagreement should be handled as a parental rights case under Vermont law.

Prosecutors say that on Sept. 22, 2009, Kenneth Miller drove Lisa Miller and her daughter from Virginia to Buffalo, N.Y.

In testimony, Ontario Mennonite pastor Ervin Horst said Kenneth Miller asked him to pick up Lisa Miller and her child in the United States. Horst said he did not feel comfortable crossing the border with the mother and child because he knew of the custody dispute, so he picked them up on the Canadian side of Niagara Falls after they crossed the border in a taxi.

He testified that Lisa Miller and Isabella were dressed in Mennonite clothing when they crossed the border and that he took them to the airport in Toronto.

When asked if he knew the background of the custody case, Horst said he didn't know the details.

"Lisa did not feel good about what was happening and wanted to protect her daughter from the situation," he said.

Kenneth Miller's lawyer, Joshua Autry, told the jury his client believed Lisa Miller had full custody of Isabella when she fled the country. Lisa Miller and Kenneth Miller are not related.

Minister on trial in international ex-lesbian child kidnap case

"Your decision is not going to be a referendum for or against civil unions in the state of Vermont," Autry told the jury at the start of the trial. "It's going to be about whether, at the time of the removal, Janet Jenkins had parental rights."

The jury deliberated only a few hours before finding Kenneth Miller guilty. He faces the possibility of three years in prison. No sentencing date was set.

Outside the courthouse were more than 100 Mennonites, who attended the court proceedings in support of Kenneth Miller. Women were wearing bonnets and men dressed in high collared shirts sang hymns, led by an older, bearded man in suspenders.

The current whereabouts of the mother and her now-10-year-old daughter are unknown.

Prosecutors say that Lisa Miller changed her and her daughter?s names to Sarah and Lydia. Court records also indicate that they have been on the move.

Court records include an email exchange between two Mennonites in Nicaragua, one suggesting getting the girl a pi?ata for her birthday. ?

?We were planning to have a special birthday party for Lydia,? the email states. ?The more children the better ? I feel dearly for these 2 dear people. And I can see it would mean a lot to them in this rough first year of there stay in Nica. I would love for Lydia?s birthday to be very special and remembered long. She is going through a lot, and her future looms greatly in front of her right now.?

The paper crafting and scrapbooking industry is evolving and we want to continue to bring you everything you love about this hobby, so we?re reconfiguring the relationship between Paper Crafts and Creating Keepsakes. But change is rarely easy, and this one is no exception because it affects people who are not only co-workers but friends as well.

In order to form an authentic partnership and bring you the best project inspiration while still recognizing the unique differences between scrapbooking, card making and paper crafting, we?ve realigned our Paper Crafts and Creating Keepsakes editorial teams with a single editor in chief and managing editor for both titles. Moving forward, I will be taking on the dual editor in chief role, and Kerri Miller will be the managing editor for both titles. Each team will maintain a separate creative editor and art director, but there will be other editorial roles that will serve both magazines. Stay tuned for more detail on that.

With this change, two Creating Keepsakes editorial positions have been eliminated ? editor in chief and managing editor. Saying goodbye to colleagues is not easy, and I?ll be back tomorrow with highlights and a tribute to Jennafer Martin and Lara Penrod, both of whom will be missed.

This week one of the fittest, healthiest women I know has had a scare.
A scary scare - that has me reeling.
And wanting to send each and every one of my beautiful girlfriends off on a mini break.

Yes, we can't 'afford' to get sick - so we?convince ourselves?we're not.
Yes, we can't 'afford' to drop any of the balls - so we run ourselves ragged.?
Yes, no one else will do it if we don't - so we do it.
Yes, so-and-so?manages even more than us - so?we can't possibly ask for/accept help.

Will it take a serious kick?in the visible panty line to make?us?prioritise our own health and happiness though?

Of course our families, partners and children need us.
They need us alive and kicking.
Healthy and happy.

I dare you (and I )?to...

  • Ignore the dust and have a cuppa.
  • Use the creche/neighbour/family member and schedule that exercise/pedicure/dance class/coffee break.
  • Put eggs on toast on the dinner menu.
  • Make that doctor's appointment - for you.
  • Say no occasionally.
  • Close the bathroom door.
  • Ask for a hand.
  • Offload some guilt - and any unnecessary energy sappers.
  • Demand a day off - and find a way to make it happen.
  • Be your own best friend - and heed the advice you would give her.

I say all of this as I look down at my lists of lists of lists? - so please?do as I say, not as I do!

I'm also slightly intoxicated by?that extra freedom, chill?and luxury that the first week of [baby free] maternity leave brings.???? Direct me here in a month's time, won't you?

Make ungainly descent from soapbox, catch breath, re-adjust knickers.
