Stars fire GM Joe Nieuwendyk after 4 seasons

DALLAS (AP) ? The Dallas Stars fired general manager Joe Nieuwendyk on Sunday after four seasons, two coaches and no playoff appearances.

The dismissal came the day after Dallas completed a 22-22-4 season. The Stars missed the playoffs for the fifth season in a row.

Owner Tom Gaglardi said in a statement that Nieuwendyk represented the Stars "extremely well" and "helped put pieces in place that will once again turn this team into a contender." He added, however, the team must go "in a different direction with our intentions set on returning to the elite" of the NHL.

The team is to announce its new GM on Monday. While the Stars have not said who it is, Gaglardi is "confident we have found the right general manager to return us to the pathway of success."

The team has refused to comment on reports that Jim Nill, Detroit's longtime assistant GM, will get the job.

The future of coach Glen Gulutzan wasn't addressed by the team in its statement. Dallas holds an option for a third season for Gulutzan, who is 64-57-9 in his two seasons after ending the lockout-shortened season with a 3-0 home loss to Detroit. The Stars dropped their last five games and won only once in their last seven after a five-game winning streak.

When asked about his job after Saturday night's game, Gulutzan said that wasn't under his control. He did praise Nieuwendyk.

"All I can say is that Joe's been tremendous for me. I think he's done a hell of a job," Gulutzan said. "You can see with our farm team and the young guys that we have here."

As a player in Dallas, Nieuwendyk won the Conn Smythe Award as playoff MVP in 1999 when the Stars won their only Stanley Cup.

When hired by Nieuwendyk two years ago to replace the fired Marc Crawford, the 41-year-old Gulutzan had never coached in the NHL. Gulutzan had been a successful minor league coach.

Crawford was hired following Dave Tippett's firing in 2009, after the Stars missed the playoffs a year after making it to the Western Conference finals. Tippett later that year replaced Wayne Gretzky as coach in Phoenix and led the Coyotes to the playoffs. He was honored as the league's top coach.

The Stars weren't eliminated from the playoff chase until Thursday night. They stayed in postseason contention even after longtime captain Brenden Morrow was traded, a week before 41-year-old points leader Jaromir Jagr and Derek Roy were dealt at the trading deadline.

Dallas got several young players and extra draft picks in those deals. Within days after Jagr and Roy were traded, the young Stars went on a season-best five-game winning streak.

Morrow waived his no-trade clause to go to Pittsburgh, which entered the playoffs as the No. 1 seed in the Eastern Conference. Morrow's rookie season in Dallas was 1999-2000, when the Stars were the Stanley Cup runner-up a year after their title.

Touch footy touches down | Surf Coast Times ? Bellarine Times ...

A new football competition has just arrived on the Surf Coast.

Touch football, which started in Australia back in 1923 is still an emerging sport in AFL-mad Victoria, but is fast gaining in popularity as a non-contact sport that is easy to learn and fun to play.

Due to popular demand, the inaugural Surf Coast Touch Football competition has just kicked off, initially comprising nine teams, over 90 players, for both guys and girls. The competition launched last week at Torquay?s Banyul Warri Fields sports precinct, with a friendly game and function.

With many family members playing in the same teams, it promises to be a real family affair, with ages ranging from 15 to 60-plus and an even gender balance between male and female players.

Organised through the Surf Coast Shire recreation facilities team in conjunction with some committed community members, the competition will run every Thursday night over the next 11 weeks until the end of June.

It follows a series of promotional days at the Cowrie Market over the past six months and a recent six-week Come and Try program that aimed to introduce newcomers to the game.

Touch football was initially played as a training technique for rugby league and also as a social game in parks. It became a recognised sport in its own right in 1968 when the first official game of touch took place in Sydney.

By the early 1970s, touch was widely played throughout New South Wales, Queensland and New Zealand. The ensuing 40 years have seen the game?s rapid expansion, particularly across the South Pacific, Europe and the United Kingdom.

This is reflected in the cultural diversity among participants in the inaugural Surf Coast competition, with many having played touch in other countries before moving to the local area.

The game is easy to learn, requires minimal equipment and has a strong social focus, all of which make it suitable for all ages and levels ? beginners are especially welcome. Played over two 20-minute periods, with a five-minute break in between, the game?s highly aerobic nature also appeals to those looking to improve their health and fitness in a fun environment.

The arrival of touch on the Surf Coast adds to the diversity of activities undertaken at Banyul Warri Fields, which have continued to grow since the precinct opened in late 2011, and further enhances its role as a valuable community asset.

With pick No. 98, the Eagles selected Southern California quarterback Matt Barkley. Three picks later, the Jaguars selected South Carolina wide receiver Ace Sanders at No. 101. Thousands Expected at Denton Arts and Jazz Festival | NBC 5 ...

Big crowds are expected as Denton celebrates its 33rd annual Arts and Jazz Festival this weekend in Quakertown Park.

The festival combines arts and crafts showcases and activities with musical acts, including local bands and national touring jazz artists. Six-time Grammy award winner David Sanborn headlines the 2013 event Friday night.

The Original Blues Brothers Band headlines on Saturday night, with Denton's own Brave Combo topping the bill Sunday.

"We have seven stages," said Carol Short, festival founder and executive director. "Our mission is to make sure that people all ages have free access to not only the performing but the visual arts."

That has stayed consistent even as the event has grown over the last three decades, she said.

The festival works year-round to raise money and get local partnerships so it can continue offering free admission to the three-day event, Short said.

"We have to raise a half a million dollars every year just to put this on," she said.

"We usually start planning 18 months in advance, so we're already working on 14 right now," said Kevin Lechler, associate director.

They're also helped along by revenues from the dozens of food vendors that line the park for the weekend.

First-time vendor and local businesswoman Grace Samano said it's a great chance for them to gain new customers who may otherwise never have a chance to try their food.

"I'm local so, you know, I'm sure there's people from all over and I'd love for them to try my food," she said.

Between the cheap fun and the numerous activities for both kids and adults, the festival has become one of the area's biggest festivals of its kind, organizers say.

"Our attendance goes back and forth between 200,000 and 225,000," Lechler said.

Organizers encourage everyone to check out the event but say visitors should prepare accordingly because parking can be an issue.

Bangladesh building collapse toll nears 300

DHAKA (Reuters) - Rescuers pulled dozens of survivors from the rubble of Bangladesh's worst industrial accident on Friday, but the death toll rose towards 300 after the collapse of a building housing factories that made low-cost garments for Western brands.

Almost miraculously, 62 people trapped beneath the rubble since the eight-storey building collapsed on the outskirts of the capital, Dhaka, on Wednesday were rescued alive overnight, police and government officials said.

However, there were fears between 300 and 400 people were still inside. "Some people are still alive under the rubble and we are hoping to rescue them," deputy fire services director Mizanur Rahman said.

Junior local government minister Jahangir Kabir Nanak said the death toll had reached 292 and H. T. Imam, an adviser to Bangladesh Prime Minister Sheikh Hasina, said it could top 350.

Anger over the working conditions of Bangladesh's 3.6 million garment workers, the overwhelming majority of them women, has grown steadily since the disaster, with thousands taking to the streets to protest on Friday.

Nanak said 41 people were pulled alive from one room on the fourth floor overnight, almost 40 hours after the Rana Plaza building collapsed with more than 3,000 people inside.

Around 2,300 people have been rescued so far, at least half of them injured, from the remains of the building in the commercial suburb of Savar, about 30 km (20 miles) from Dhaka.

An industry official has said 3,122 people, mainly female garment workers, had been inside the building despite warnings that it was structurally unsafe.

Bangladesh is the second-largest exporter of garments in the world but many factories remained closed for a second day on Friday, with angry garment workers protesting against poor conditions and demanding the owners of the building and the factories it housed face harsh punishment.

Police and witnesses said protesters set fire to a number of vehicles and damaged other garment factories.

Dhaka District police chief Habibur Rahman identified the owner of the Rana Plaza building as Mohammed Sohel Rana, a leader of the ruling Awami League's youth front.

Imam, the prime minister's adviser, said Rana had "vanished into thin air".

"People are asking for his head, which is quite natural. This time we are not going to spare anybody," Imam said.

STRING OF FATAL INCIDENTS

Wednesday's building collapse was the third major industrial incident in five months in Bangladesh. In November, a fire at the Tazreen Fashion factory on the outskirts of Dhaka killed 112 people.

Such incidents have raised serious questions about worker safety and low wages in Bangladesh and could taint the poor South Asian country's reputation as a producer of low-cost products and services.

North American and European chains, including British retailer Primark and Canada's Loblaw, said they were supplied by factories in the Rana Plaza building.

Mohammad Atiqul Islam, president of the Bangladesh Garment Manufacturers and Exporters Association (BGMEA), said the proprietors of the five factories inside the building had ignored the association's warning not to open on Wednesday after cracks had been seen in the building the day before.

"We asked not to open the factories and told them we will send our engineer, and until you get the green signal don't open the factories," Islam told Reuters.

"But unfortunately they violated our instructions," he said. A bank in the building did close on Wednesday after the warning.

PRAYERS, MOURNING

Savar residents and rescuers dropped bottled water and food on Thursday night to people who called out from between floors. Nearby, relatives identified their dead among dozens of corpses wrapped in cloth on the veranda of a school.

Special prayers were offered for the dead, injured and missing at mosques, temples and pagodas across Bangladesh on Friday.

Ten labour groups called for a strike on Sunday by workers at garment factories across the country.

Sixty percent of Bangladesh's garment exports go to Europe. The United States takes 23 percent and Canada takes 5 percent.

Primark, a unit of Associated British Foods, has confirmed one of its suppliers occupied the second floor of the building. Danish retailer PWT Group, which owns the Texman brand, said it had been using a factory there for seven years.

Canada's Loblaw, a unit of food processing and distribution firm George Weston Ltd, said one factory made a small number items for its "Joe Fresh" label.

Primark, Loblaw and PWT operate under codes of conduct aimed at ensuring products are made in good working conditions.

Documents including order sheets and cutting plans obtained by Reuters appeared to show that other major brands such as Benetton had used suppliers in the building in the past year.

A Benetton spokesman said none of the factories were suppliers to the company. Spain's Mango said it had an unfulfilled sample order at the plaza with Phantom Apparel.

Stephen Wolfram says he almost had a deal with Google, but it 'blew up'

As you may recall, Wolfram Research signed a deal with Microsoft a few years back that saw some Wolfram Alpha functionality integrated into Bing. As it turns out, it very nearly found its way into a certain other search engine as well. In an interview at The Next Web conference in Amsterdam today, Stephen Wolfram revealed that his company had tried to work with Google and "almost had a deal," but it "blew up." Unfortunately, he didn't provide any further details about when those talks took place or exactly what the potential deal entailed, and it doesn't sound like we can expect that deal to revived anytime soon -- especially considering Google's own efforts that are increasingly overlapping with Wolfram Alpha. As Wolfram himself notes, though, the two companies do have something of a longstanding connection: Google co-founder Sergey Brin was actually an intern at Wolfram way back in 1993.

Woman's fortune should go to grandson, not police ... - Estate of Denial

PORTSMOUTH ? About $300,000 in a will, left to police Sgt. Aaron Goodwin by an elderly resident whose competency is being challenged, should legally go to her grandson, said attorney Paul McEachern.

The resident, Geraldine Webber, died in December at age 94, seven months after she endorsed a new will and trust that names Goodwin as the beneficiary of her riverfront home, stocks, a bond and a Cadillac. Webber?s 2012 estate plan put all of her assets into a trust, including the $300,000 in her will, with Goodwin named as the trustee, according to probate court records.

A prior will Webber endorsed in 2009, through attorney James Ritzo, names Webber?s disabled grandson, Brett Webber, as a $25,000 beneficiary. But in the 2012 will and trust Webber endorsed through attorney Gary Holmes, her grandson is not named.

McEachern, who plans to challenge the latest will and trust, on the grounds that Webber was incompetent when she endorsed them, said because the grandson was named in the 2009 will, then excluded from the 2012 estate, he?s a ?preterminated heir,? or ?an heir who should?ve been listed.?

McEachern said that under probate law, Webber?s grandson should have been named in the 2012 will and trust, even if it was to say Webber was leaving him nothing.

?As a preterminated heir, the assets in her will would go to her grandson under the law as I read it,? he said.

McEachern is representing several people who were named in Webber?s 2009 will, then excluded from the 2012 will and trust. He said he planned to represent Webber?s grandson, but after reading both estate plans and concluding that Brett Webber should inherit everything in his grandmother?s will, he now has a conflict of interest because he?s challenging the will and trust.

McEachern said he?s got about six months to file paperwork with the county probate court on behalf of his clients. He said he watched a video recording of Webber signing the 2012 estate documents and said he?ll challenge her competency, as well as ?undue influence? Goodwin is alleged to have exerted over Webber before she changed her estate plans.

Ritzo previously alleged Goodwin ?romanced? Webber by taking her to casinos and out for drinks. He alleged in probate court records that Goodwin ?shopped? Webber?s will around to ?at least four? lawyers before Holmes took the case. Ritzo has also said he was Webber?s lawyer for years and her wishes remained consistent until she asked him to change her estate so she could ?leave everything to Aaron.?

Goodwin provided Seacoast Media Group with the following statement: ?The allegations that I exploited a member of our community are completely untrue.? With that response, he also attached letters from the state Bureau of Elderly and Adult Services, dated June 12 and Sept. 19, 2012, stating that two investigations into complaints of elder exploitation by him regarding Webber were conducted and both were concluded as unfounded.

Joanne Peterson of Florida is Webber?s daughter-in-law and mother of the grandson McEachern thinks is entitled to the $300,000 in the will. Peterson said her son is 45 years old and has brain damage, as well as speech and hearing impairments. She said her family will get him a lawyer to challenge his grandmother?s estate.

?He?s her only living relative,? she said.

In a written statement dated March 6 and provided to SMG, Peterson said Webber ?had dementia? in her last years and that ?anyone who talked to her would have known it.? Peterson also wrote in her statement that Webber?s financial support for her grandson ? a small monthly interest check on a certificate of deposit ? ended when Webber met Goodwin.

Before she died, Webber told SMG during a 25-minute interview that she first met Goodwin when he responded to her home after she called police to report ?members of the nation?s gang? were on her property.

?You bet he is,? she said when asked whether Goodwin was a beneficiary of her will and trust. ?It?s my money and my house and I?ll do as I (expletive) please.?

Also named as a beneficiary in Webber?s latest will and trust is police Capt. Mike Schwartz for $25,000.

Ritzo has asked the court to award him a $65,000 payment from Webber?s estate for the quarter century he said he worked as her lawyer, but was not paid.

Before Webber?s trust was amended by Holmes, the terms of the will Ritzo wrote for her bequeathed $240,000 to Braintree (Mass.) High School for a scholarship in memory of Webber?s late son, Bruce. The new trust leaves the high school $25,000.

The will Ritzo wrote for Webber also stated her assets would be sold and, after her bills were paid, one-fourth of the money would be given to the Sloan Kettering Cancer Research Clinic in New York, one-fourth given to the Shriners Hospital for Children-Boston, and the other half split between the Portsmouth police and fire departments.

The new and disputed trust gives those parties $25,000 each, about 90 percent less.

Ritzo said he believes Webber?s stocks and bonds are worth $700,000 and her home, which features boat docks and an in-ground swimming pool, is assessed for $805,000.

What's the Back-Up Plan for Health Insurance Exchanges?

Yet another problem has appeared that could stymie the Affordable Care Act?s successful implementation: what if we need a back-up plan to evaluate and certify the health plans that are going to be sold on the law?s online insurance marketplaces?

As it stands now, there isn?t an official one. On and off the record, officials at the U.S. Department of Health and Human Services (HHS) assured Governing that there was a secondary plan, but they declined to provide details. Industry sources say they aren?t aware of any such back-up plan?which concerns many of them?but there are a few theories out there.

Here?s the issue: Somebody has to review and certify the health insurance plans that will be sold on the online marketplaces, formerly known as exchanges, created by the federal health reform law. In the 18 state-run exchanges, the state is responsible for doing that review and certification. In the 13 states that are partnering, openly or silently, with the federal government on their exchange, the state is also responsible. In the 19 states fully defaulting to a federal-run exchange, HHS will oversee this process, known as plan management.

That?s how it?s supposed to work. But in practice, it might not be so straightforward. At least five state-run exchanges?Colorado, Idaho, Kentucky, New Mexico and Rhode Island?have yet to start accepting plan applications. If they have serious problems in the next few months--and it is a real possibility that some of them will--they could potentially have to hand plan management over to the feds. Additionally, any of the partnership states, most of which have some degree of state-level opposition to the ACA, could theoretically drop out of that partnership and leave plan management to HHS.

If that happens, nobody is sure how review and certification will be handled. Most states and HHS are allowing several months for the full application and certification process to be completed. With the marketplaces slated to open on Oct. 1, that doesn?t leave a lot of time if things go awry. The federal government is ending its application period for the federal-run exchanges in the next few weeks. If a state doesn?t figure out until a later date that they can?t do plan management and must give that responsibility to the feds, the administration has no obvious mechanism for asking health insurers to submit their plans to HHS instead.

It?s all theoretical right now. But some insurers are worried that it could become a reality very soon.

?That?s a question we?ve been asking ourselves. Nobody?s heard a word,? says one official at a top insurer, who spoke on the condition of anonymity. ?At the end of the day, we're questioning whether HHS is going to be fully ready, and we don't know what that means if they aren?t.?

What?s the worst-case scenario? If responsibility for plan management is shifted from the state to the feds at the last minute, that could possibly delay the exchange?s opening until after Oct. 1, says Caroline Pearson, who tracks ACA implementation for Avalere Health, an independent consulting firm.

That might not have a huge practical effect for those who enroll?coverage being sold on the exchanges starts Jan. 1, 2014, so there is some lag time?but it would be a significant political blow to the Obama administration, which has steadfastly insisted that the marketplaces would launch on time. It could also complicate public outreach if people don?t know when their state?s exchange is actually opening.

?That could slow down enrollment and slow down marketing. It probably reduces overall enrollment,? Pearson says. ?I think we've got time before you hit that point, but I?m beginning to get nervous.?

So how does this get resolved? There are a few apparent possibilities, though HHS is staying silent on what their plan is. One rumor, relayed to Governing by a knowledgeable source, is that the feds would ask any insurer planning to sell a plan on any state?s marketplace, including state-run and partnership exchanges, to submit their information to HHS before the federal application period ends in the next few weeks. That way, if the state fails to complete its plan management, the feds already have all the information they need to review and certify the plans themselves.

One insurance industry source said that sounded ?plausible,? but hadn?t received any request directly from HHS. Another said they were under the impression that this is a rumor that is floating around the industry, but there were no indications that the feds would actually take that route.

The other possibility involves the two different electronic systems that states and HHS are using to solicit plan information from insurers. The state-run and partnership exchanges are using software called SERFF, which state regulators have used for years to collect information from insurers and review plans. The federal government is using HIOS, which is a separate system but performs essentially the same function.

SERFF and HIOS are capable of transmitting information to one another, one-state level source confirmed to Governing. So, in theory, a state-run or partnership exchange worried about its ability to complete plan management could ask insurers to submit their information to SERFF. Then if the state decides later that it can?t oversee plan management, the information already in the SERFF database could then be moved to HIOS, and HHS could take over.

One insurance industry source said they had heard that this would be HHS?s back-up plan if things go wrong with plan management in some states. HHS declined to confirm that on the record. So until these issues are resolved and open enrollment arrives on Oct. 1, the uncertainty will continue to linger.

Draft bill gives FDA authority over certain pharmacies

(Reuters) - The Food and Drug Administration would gain greater authority over pharmacies that compound sterile drugs for tailored use and ship them across state lines, under proposed legislation announced on Friday.

The proposal from a bipartisan group of senators comes in the wake of a meningitis outbreak linked to a tainted steroid that has killed 53 people and sickened more than 700. The steroid was distributed by the Framingham, Massachusetts-based New England Compounding Center.

The proposal would draw a distinction between traditional compounding pharmacies, which make drugs for individual patients in response to specific prescriptions, and those such as NECC which make and ship products around the country that physicians can keep on their shelves for future use.

Ever since the meningitis outbreak, the FDA has been pilloried by Republicans in Congress who maintain the agency should have been more aggressive in its oversight of NECC.

The FDA concedes as much but argues that a complex legal landscape, combined with resistance from compounding pharmacies, has hampered its ability to regulate an industry that has grown exponentially over the past 10 years and whose function in many cases has changed.

The proposed legislation would essentially create a new class of drug company, to be known as "compounding manufacturers," that would be regulated by the FDA but be exempt from the full raft of regulatory requirements that apply to big pharmaceutical companies.

They would not, for example, be required to submit their products to the FDA for approval before selling them, and they would not have to enter complicated negotiations with the agency about what should and should not be included in the package insert. They will be required to provide more limited information.

It is unclear how many of the roughly 2,800 compounding pharmacies would fall into the new category but initial estimates place the number at fewer than 500. They would be defined not by their sales volume, but by whether they make products that are at high risk for contamination and sell them across state lines.

These newly-defined companies would no longer be licensed as pharmacies. They would be required to register with the FDA, and report to the agency any problems reported by patients or physicians. They would also be required to pay an annual fee to defray the cost of FDA inspections.

Traditional compounding pharmacies would continue to be licensed and regulated by state boards of pharmacy.

Jake Davidson, a 17-year-old from Los Angeles, realized prom season was fast approaching and he didn?t have a girlfriend. That could prove troubling for some, but not Jake. He?s got an easy out. He?ll just use his video editing skills and social media network to make a humble plea for super model Kate Upton to be his prom date.

The promposal seen round the web spread from online person to online person faster than a One Direction music video release.

In the video, Jake says going to prom with Ms. Upton pre-ordained, it is destiny. She?s the yin to his yang. Why? While doing pushups, Jake makes his case which would, if we?re honest, easily pass the muster of Standford?s doctorate thesis committees: She likes sports, he likes sports. She likes fine dining, he likes fine dining. She?s on the cover of Sports Illustrated, and he reads Sports Illustrated.

Watch out Johnnie Cochrain, this kid?s going on the offensive and his evidence is air-tight.

?Upton?s first response was through Twitter. It was only a maybe, but gave Jake more hope for success than the cross-town Los Angeles Clippers ever had. The media soon caught up and Jake was invited for an interview on the Today Show. Discarding formal attire and the first two buttons of the casual plaid shirt he did wear, Jake reminded everyone why he asked Upton (again, a common interest in sports). Then, surprise, Upton came on and stunned Jake with a formal ?I do? to his promposal.

The honeymoon was, as it always is, too short. Upton, once the media hullabaloo subsided, soon reneged. She won?t be going with Jake after all. Publicity doesn?t care whose heart it breaks.
